1) Overview
Truthwave House controls copyright in certain sound recordings and music videos. This policy explains how we handle direct licences for public performance and communication/transmission of our recordings in Australia and worldwide, except where local collective management organisations (CMOs) or statutory schemes administer those rights.
Note: Rights in the underlying musical works and lyrics (publishing) are separate and administered by the relevant publisher or songwriter (commonly via APRA AMCOS or a foreign affiliated society). These are not covered by this policy.
2) Do we offer direct licences?
Yes, we offer direct licences on a case-by-case basis. However, if your use is already covered by a PPCA or OneMusic blanket licence, you may not need a separate direct licence from us.
2a) Territory & carve-outs
We can grant direct licences worldwide. However:
If a local CMO (or law) controls public performance/communication of sound recordings in a country, licensees should obtain coverage from that CMO (or applicable scheme).
This policy does not override compulsory/statutory licences (e.g., certain broadcast/digital regimes).
Synchronisation (master) is licensable by us globally unless otherwise noted in a specific deal.
3) Alternatives to a direct licence (by region)
Many public-performance/communication uses are covered by local CMOs. Check these before seeking a direct licence for those uses:
AU/NZ: OneMusic Australia (APRA AMCOS + PPCA) / PPCA; OneMusic NZ.
UK: PPL (recordings) + PRS (publishing).
EU examples: GVL (DE), SCPP/ADAMI (FR), SCF (IT), SGAE + AGEDI/AIE (ES).
USA: No general public-performance right in sound recordings for terrestrial venues/broadcast; SoundExchange covers non-interactive digital performance of recordings; publishing via ASCAP/BMI/SESAC/GMR.

6) How we assess and price
We consider scope, prominence, audience size, term, territory, exclusivity, and reporting requirements. Fees may be structured as flat rates, per-use charges, or revenue percentages. GST applies where relevant.
Important: You may also need separate licences from other rights holders (e.g., for publishing).
7) Reporting & credits
Licensees must provide reasonable usage reports (e.g., cue sheets, logs, URLs) during the licence term. Where practical, please credit:

8) Payment & invoicing
Invoices are issued upon execution or at milestones specified in the licence agreement. Payment terms are [e.g., 14 days from end of month]. Late payments may result in licence suspension until payment is received.
9) Complaints or disputes
Please email licensing@truthwavehouse.io. We aim to respond within 10 business days. If the matter remains unresolved, we may seek independent resolution.

12) Legal & compliance
Governing law: This policy is governed by the laws of Australian Capital Territory, Australia, unless another jurisdiction is agreed in a specific licence.
Taxes/withholding: Fees are exclusive of taxes; GST (if applicable) will be added. International licensees are responsible for any withholding; gross-up or evidence of withholding may be required.
Sanctions/ABAC: Licensees warrant compliance with applicable sanctions, anti-bribery, and trade laws.
Data protection: Personal data is handled per our Privacy Policy (e.g., GDPR/UK GDPR/APPs).
